FoxCheck Terms of Service

Effective from: May 1, 2026

1. Introductory Provisions

1.1. These terms and conditions (the "Terms") govern the mutual rights and obligations arising in connection with the use of the Software as a Service (SaaS) named FoxCheck (the "Service" or "Platform").

1.2. The Service Provider is the operator of the FoxCheck platform. The Customer is an educational institution, school, or other entity that concludes a contract for the Service for online testing and cheating prevention (the "Customer").

1.3. The Service is exclusively for the B2B sector. End users (students) use the Service solely under the authorization and administration of the Customer.

2. Description of the Service

2.1. The FoxCheck Service is used for administering tests and monitoring testing to prevent fraud.

2.2. The "Anti-cheat" module logs browser activity (e.g. window focus loss) providing evaluators with data to assess test integrity.

2.3. The Service is provided in various tiers. The "Free" tier has limited features, while the "Enterprise" tier offers full functionality.

3. Formation of the Contract

3.1. The contractual relationship is formed upon successful registration and agreement to these Terms.

4. Rights and Obligations of the Customer

4.1. The Customer agrees to use the Service in accordance with EU laws and these Terms.

4.2. The Customer is fully responsible for having a legal basis to collect student data. The Customer acts as the Data Controller, the Provider exclusively as the Data Processor.

4.3. Scraping or attempting to bypass security features is prohibited.

5. Payment Terms

5.1. Paid plans are billed in advance based on the agreed billing cycle.

6. Limitation of Liability and SLA

6.1. The Provider strives for 99.9% uptime, but the service is provided "as is".

6.2. Decisions regarding test validity based on "Anti-cheat" data are made exclusively by the Customer.

7. Final Provisions

7.1. The Provider may amend these Terms. Updated terms will be published on the Platform website.

7.2. These terms are governed by the laws of the Czech Republic.
